The following words and expressions used in this Agreement shall have the following meanings:
"Accessories" means products approved or provided by OneSimCard.com which can be used in conjunction with a Device. These include, but are not limited to batteries, chargers, car kits, headsets and carry cases.
"Connection" means the process of providing you with access to the Services.
"Customer", "User", "You" "Your" or other like terms means the person or entity who or which agrees to be bound by the terms of this Agreement.
"Device" means a Phone or a SIM Card
"Network" means a GSM cellular network.
"Personal Extra Number" means a phone number, leased by a user from OneSimCard.com, which enables a user to receive incoming calls and communicate by voice to and from an Android or iOS phone via the OneSim VoIP Mobile Application.
"Phone" means mobile phone approved by or provided by OneSimCard.com for use including a mobile phone containing a SIM Card which is approved by or provided by OneSimCard.com for use.
"Rates" means our Rates for use of the Services, located at http://www.OneSimCard.com.com/cell-phone-rates/ and in effect from time to time. All calls are billed in one minute increments with call duration rounded up to the next whole minute.
"Registration" means our acceptance of an application for Services and/or Devices and our record of Customer and User data prior to Connection. To 'register' shall mean to begin the process of registration and constitutes the time after which an application has been submitted but before acceptance by OneSimCard.com.
"OneSim VoIP Mobile Application" means an application downloadable from OneSimCard.com upon the lease by the user from OneSimCard.com of a Personal Extra Number which allows a user to communicate by voice to and from an Android or iOS phone.
"Recharge" means adding funds to a SIM Card or Corporate Account.
"Roaming" means a Service which allows the use of a Phone on other operators' Networks, usually in foreign countries.
"Services" means Roaming, messaging, internet and forwarding services, the OneSim VoIP Mobile Application and other services offered from time to time by OneSimCard.com and ordered by the User.
SIM Card: A device which contains your personal telephone number and is programmed to allow access to the Network. The term SIM Card shall include SIM cards included in Phones provided by OneSimCard.com.
Suspension: The temporary disconnection of Services.
|RATES AND CHARGES|
The Rates applicable to the Service shall be as set forth on the rates tab on the OneSimCard web site at: http://www.onesimcard.com/cell-phone-rates/. These Rates are net of any and all taxes and surcharges that are mandated by applicable law or otherwise imposed upon the Service by federal, state local or other foreign or domestic governmental authorities. These taxes and surcharges will be invoiced to the Customer in addition to the Rates and Customer agrees to pay or reimburse OneSimCard for these taxes and surcharges as and when invoiced by OneSimCard in accordance with applicable law.
As the rates for telecommunications services, in general, are constantly changing, OneSimCard shall have the right to change the Rates applicable to the Services at any time with or without notice to you. Accordingly, it is your responsibility to ensure that you review the rates for our Services at http://www.onesimcard.com/cell-phone-rates/ regularly so that you will be aware of the current Rates applicable to the Services you have selected. OneSimCard may also amend other terms of this Agreement at any time provided that OneSimCard gives prior written email notice to you of such changes.
If at any time the credit card you have provided to fund your Account is invalid, or payment is declined by the credit card issuer at the time a charge is attempted, or if you otherwise fails to pay any amount when due under this Agreement, OneSimCard may discontinue the Service and you will not be able to use the Service until your account is paid in full.
All OneSimCards are designed to work within the countries where pricing is published for that particular SIM card on the www.onesimcard.com website under the “Rates & Coverage” tab. Users should be familiar with the list of countries where pricing in published and should only use their OneSimCard in countries where pricing is published. In the event that the OneSimCard is used in a country where no prices are published, the user is responsible for payment of these services and funds for the services will be deducted from the user’s account.
|SIM ACTIVATION, MINIMUM MONTHLY USAGE & MONTHLY MAINTENANCE FEES FOR INACTIVE SIMS|
OneSimCard allows 60 days after the SIM purchase for SIM to be activated. If Customer has not activated the SIM within 60 days after the SIM purchase, the SIM will be activated automatically.
Each active OneSimCard within a corporate account is subject to a minimum monthly usage of $2.00 per month. OneSimCards with monthly usage of less than $2.00 per month will be charged the difference up to $2.00 per month. If the total usage on the SIM card during the monthly period is over $1.99, you will not incur any additional charges. The 30 day SIM billing period begins the day the SIM card is activated.
Each temporarily blocked OneSimCard within corporate accounts will be charged a $0.99 monthly maintenance fee.
Customer can permanently remove any SIM card from the account if the SIM is no longer required.
|PROVISION OF SERVICES|
We will take all reasonable steps to make all Services available to you at all times. However, we cannot and do not make any guarantees that the Services will be uninterrupted or error free. Without limiting the generality of the preceding sentence, please note that:
Customer can terminate Services at any time by providing written notice to OneSimCard.com Support. No refunds of any Account balances will be given upon your termination of the Services.
Your SIM Card(s) will expire if no calls are made using your SIM Card(s) for 2 consecutive years. No refunds will be given upon expiration of your SIM Card even if, at the time of expiration, your SIM Card had a positive balance.
Personal Extra Numbers will stay active as long as they have been funded properly. You will be unable to use your Personal Extra Number and the OneSim VoIP Mobile Application at any time when your Personal Extra Number Account is not properly funded.
|RETURNS AND REFUNDS|
If you are not satisfied with a Device or Accessory you purchased, you may return it for exchange or refund of the purchase price for the Device or Accessory (less shipping and handling charges) within 30 days of our shipment of the Device or Accessory to you, provided that you never received a call to, or placed a call from, the returned Device and all airtime is intact. Keep your Devices, Accessories and all packing materials in new and unused condition to avoid any restocking fees. All returns require an RA (Return Authorization) number. For an RA (Return Authorization) number, call Customer Service at 1-617-313-8888. Please note that an RA # does not guarantee final disposition and all returns are subject to inspection. All exchanged/returned merchandise must be in the original factory carton, including all packaging materials, inserts and manuals, warranty cards (not filled-out) and all Accessories. Please do not tape or write anything on the item or the original manufacturer's carton. In some cases, we may charge you and reduce your credit for the replacement of damaged, altered, missing, written-on or taped-on contents or cartons. We reserve the right to refuse any such items.
There will be no refunds for the airtime used on mis-dialed calls. If you are not sure how to dial a number in a specific country, please request support from customer service.
There will be no refunds for sent SMS messages - either the messages were delivered to the recipient or they were not. Not all SMS messages can be or will be delivered.
There will be no refunds for Internet data usage. If the charge occurred then data was moved and you were charged accordingly.
There will be no refunds for minutes used for calls to Customer Service. A call made to Customer Service will be billed at the same rate as a regular call made from the country in which you are located as provided in the Rates and Coverage menu of www.OneSimCard.com.
Unless you have the Plus SIM version, we strongly urge you not to place completed calls while in the USA and Canada, as this can be very expensive. You can always test a number by making a call from your OneSimCard.com phone and not answering when you receive the callback. There will be no charge for this call if you did not answer the callback ring. Contact OneSimCard.com Support for help.
There will be no refunds for expired SIM Cards, even if, at the time of expiration, the SIM Card Account had a positive balance.
OneSimCard.com will exchange a defective Phone or SIM Card within 3 months of the purchase, provided that the phone or SIM Card was not damaged by the customer.
There will be no refunds for Personal Extra Numbers once ordered.
There will be no refunds of Account balances upon a termination of the Services by a user.
|PERSONAL EXTRA NUMBERS|
A Personal Extra Number (PEN) enables customers to receiving incoming voice calls and use the OneSim VoIP mobile application. A PEN will not accept or forward SMS text messages. Customer understands and agrees that it is not the owner of any PEN assigned to customer or by OneSimCard. Ownership of any such PEN is vested solely in OneSimCard (which will assign such numbers to customer for its use during the term of this Agreement). Customer understands and agrees that following the termination of customer's account for any reason, such PEN may be re-assigned immediately to another OneSimCard customer, and that OneSimCard will not be liable for any damages (including consequential or special damages) arising out of any such re-assignment, and customer hereby waives any claims with respect to any such re-assignment. Customer further understands and agrees that OneSimCard may from time to time need to change the PEN assigned to customer (whether due to an area code split or any other reason whether outside or within OneSimCard's control). Customer agrees that OneSimCard will not be liable for damages (including consequential or special damages) arising out of any such change in the PEN assigned to it, and customer hereby waives any claims with respect to any such change. Without limitation of the foregoing, Customer agrees that neither it nor its users are authorized to charge services provided to Customer or at Customer's or its users' request to the numbers assigned to Customer by OneSimCard and that Customer will not, and will cause its users to not, request or otherwise cause any third-party service provider to charge any such services to such numbers. OneSimCard may terminate Customer's account immediately and without notice upon the incurrence of any such charges.
|Fair Use Policy|
OneSimCard reserves the right to discontinue Unlimited Data Package services to any customer who significantly exceeds the average monthly data usage across our network. Unlimited Data Package can be used only by a single mobile device for a regular use – web browsing, GPS navigation and emailing. It can’t be used with Mi-Fi router distribution and peer to peer data moves. Generally, Unlimited Data Package customers using more than 4000 MB of data per package may face the risk of discontinued services. If services are discontinued for Fair Usage violation, OneSimCard will not provide a data package refund.
